Terms

Terms of Use

A short, honest agreement for using this website — written to be read, not to hide behind.

These terms cover your use of the SubMergence website and the forms on it. They're intentionally plain. By browsing the site or sending us a message through it, you're agreeing to what's below.

Using this site

You're welcome to read, explore, and reach out. In return, please use the site as it's intended: don't attempt to break, overload, scrape, or misuse it, don't submit the forms with false identities or on someone else's behalf without their knowledge, and don't use anything here to do harm. The words, images, music references, and SubMergence name and marks on this site belong to SubMergence and are shared with you for your own use, not for republishing or resale.

Reaching out through the forms

The forms here start a conversation — they are inquiries, not contracts. Submitting one doesn't reserve a rental, confirm a booking, guarantee a partnership, or complete a purchase or subscription. Anything firm — a session, a shop partnership, a headset, music access — is arranged directly with us afterward, on its own clearly stated terms. Please give us accurate information so we can actually help.

Availability and accuracy

We work to keep this site accurate and online, but we offer it as-is, without warranties. Details like pricing, locations, availability, and launch timing can change as the work on the water evolves, and the site may occasionally be unavailable for maintenance or reasons beyond our control. Nothing here is a promise of uninterrupted service.

Limits

To the extent the law allows, SubMergence isn't liable for indirect or incidental losses arising from your use of this website. This page concerns the website itself; the safety, rental, and partnership terms for in-water experiences and shop agreements are handled separately, in their own signed documents and waivers.

Where these terms live

SubMergence operates from Kaua'i, Hawai'i, and these terms are governed by the laws of the State of Hawai'i. If any part of them can't be enforced, the rest still stands.

Changes

As SubMergence grows, these terms may be updated to stay accurate. The current version always lives here, and continuing to use the site means the current version applies.

Questions

If anything here is unclear, ask — a person will answer. Reach us through the contact page or email [email protected].
